Terms and Conditions

Last updated — 11/07/2026

1. Introduction

Welcome to www.ultracleany.com. These Terms and Conditions (hereinafter the “Terms”) govern access to and use of our website and the purchase of products through it.

The website is operated under the Ultra Cleany brand by the legal entity identified in Section 2, referred to in these Terms as “Ultra Cleany,” “we,” “us,” “our,” or the “Company.”

By using the website or placing an order, you agree to these Terms to the extent that they have been validly brought to your attention and accepted under applicable law. If you do not agree, please do not use the website or place an order.

You must have the legal capacity to enter into the transaction. If you place an order on behalf of another person or an organization, you represent that you have authority to do so.

Please retain a copy of the Terms and order information applicable to your purchase.

These Terms are subject to mandatory consumer protection laws. Nothing in them excludes or restricts rights, remedies, guarantees, or liabilities that cannot lawfully be excluded or restricted.

2. Company Information

3. Acceptance of the Terms

By accessing our website, you agree to comply with these Terms and applicable laws and regulations.

We reserve the right to modify these Terms. Updated Terms take effect for subsequent website use and transactions once published and validly communicated or accepted where required.

The version accepted when you place an order governs that order, unless a later change is required by law or separately agreed with you. Changes do not retrospectively remove accrued rights or impose arbitration on an existing dispute without a valid agreement.

Any acceptance required for the arbitration agreement in Section 14 must satisfy applicable contract formation requirements. Publication of these Terms does not replace any legally required notice or assent.

Order-specific information and expressly advertised guarantees form part of the transaction where applicable. Our Shipping Policy and Return and Refund Policy supplement these Terms. Mandatory law prevails over conflicting provisions, and Section 14 controls the scope of the arbitration agreement.

4. Website Use

Access and Browsing

You may access and browse our website without registering. Creating an account may be necessary to purchase products or access certain services.

Prohibited Use

You must not use the website for unlawful activities or in a manner that could damage, disable, compromise, or overload the website or our services.

Prohibited conduct includes fraud, impersonation, unauthorized access, malicious code, interference with security features, unlawful collection of personal information, infringement of third-party rights, and submission of knowingly false information.

You must not use automated tools to circumvent purchasing limits, security controls, or access restrictions.

Intellectual Property

Website content, including text, graphics, logos, images, videos, and software, belongs to Ultra Cleany or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, commercially exploit, or create derivative works from that content without authorization, except as permitted by law.

Third-Party Websites and Services

The website may include links, embedded content, or services provided by third parties. Those providers have their own terms and privacy practices.

To the extent permitted by law, we are not responsible for independent third-party websites, statements, or transactions outside our control. This does not exclude responsibility for providers acting on our behalf where applicable law makes us responsible.

Social Media

Comments posted by users on social media represent their own views. We may moderate content for spam, unlawful material, threats, infringement, or other legitimate reasons, subject to applicable law.

We do not prohibit honest reviews or lawful criticism.

5. User Registration

Account Information

When creating an account, you agree to provide accurate, current, and complete information and keep it updated.

You are responsible for keeping your login credentials confidential and taking reasonable steps to prevent unauthorized access. Notify us promptly if you suspect an account security issue.

Responsibility for unauthorized account activity is determined under applicable law and is not automatically assigned to you regardless of its cause.

Account Suspension or Cancellation

We may suspend or cancel an account where we reasonably believe it is being used fraudulently, unlawfully, in material breach of these Terms, or in a way that threatens the security of our services or other users.

Where appropriate and legally required, we provide notice and an opportunity to resolve the issue. Suspension does not remove your rights concerning paid orders, refunds, warranties, or existing claims.

6. Purchasing Process

Products and Availability

Products are subject to availability. We may modify, discontinue, or update products offered for future purchases without prior notice.

Changes do not authorize us to substitute a materially different product for an accepted order without your agreement.

Descriptions and images are intended to present products accurately. Display settings may affect how colors appear. Minor presentation differences do not remove your right to receive products conforming to their description.

Cleaning results may vary according to the item, its condition, the type of buildup, and compatibility with ultrasonic cleaning. Specific factual descriptions and express promises remain subject to applicable law.

Prices

Prices are shown in the currency displayed on the relevant product page and at checkout.

Applicable taxes are included or separately identified as required by the laws governing the transaction. Shipping charges and other charges payable to us are disclosed before you submit the order.

Import duties, customs charges, or taxes payable separately on international shipments are your responsibility only where that allocation has been clearly disclosed before purchase and is lawful. If we state that duties or taxes are included, that statement applies.

Your bank or payment provider may impose currency conversion or transaction charges outside our control.

Payment

We accept the payment methods displayed at checkout, which may include credit or debit cards, PayPal, and other secure payment systems.

By ordering, you confirm that you are authorized to use the selected method and authorize collection of the disclosed total.

We may request reasonable verification to prevent fraud. We do not impose undisclosed recurring charges through a one-time purchase.

Order Confirmation and Acceptance

After ordering, you receive an acknowledgment email confirming receipt. Unless that email expressly states otherwise, acknowledgment does not itself constitute acceptance.

We accept the order when we send an express acceptance or dispatch confirmation, subject to any earlier contract formation required by applicable law.

Before acceptance, we may reject an order for reasonable grounds, including unavailability, payment failure, an evident pricing error, suspected fraud, or an unlawful transaction.

After acceptance, cancellation or amendment is permitted only under applicable law or by agreement. If we cancel an order for which payment has been collected, we refund the amount due.

Order Changes and Cancellation Requests

Contact contact@ultracleany.com promptly if you need to correct an address or request cancellation. We cannot guarantee operational changes once fulfillment has begun. This does not restrict a statutory cancellation or withdrawal right.

Purchasing Limits and Resale

Unless separately agreed, website purchases are intended for personal or household use. We may apply reasonable quantity limits or decline orders reasonably identified as unauthorized bulk resale before acceptance.

Payment Disputes

Please contact us if you believe a charge is incorrect so we can investigate. This does not restrict lawful chargeback rights, payment-provider remedies, or statutory complaints.

7. Shipping and Delivery

Shipping Methods

Available shipping options are displayed during checkout. We use shipping companies and fulfillment providers selected according to the destination and service.

Processing and transit times may differ. Delivery estimates depend on location, shipping method, stock availability, and customs processing.

Delivery Times and Delays

Delivery times are estimates unless expressly guaranteed. We are not responsible for delays beyond our reasonable control to the extent permitted by law.

However, customs delays, weather, strikes, or carrier problems do not automatically remove statutory obligations to deliver, notify you of delays, obtain agreement to a revised timeframe, or provide cancellation and refund remedies.

Where applicable, we comply with legal requirements governing shipment promises and delayed orders.

Delivery Information

You must provide accurate delivery information and notify us promptly of errors.

Where an error attributable to you causes additional delivery costs, we may charge reasonable, documented costs where lawful. We do not impose such charges where the error was ours or the carrier’s and applicable law makes us responsible.

Risk and Responsibility

Where mandatory consumer law provides that transit risk remains with the seller until physical delivery to you or your designated recipient, that rule applies.

For other transactions, risk transfers on confirmed delivery to the agreed address, unless another lawful delivery arrangement was expressly agreed before purchase.

Handing a parcel to our selected shipping company does not, by itself, remove our obligations to you.

We provide tracking information where available. Carrier tracking and delivery records may be considered evidence but are not automatically conclusive proof of receipt in every case.

Lost, Damaged, or Disputed Deliveries

Contact us promptly if a parcel appears lost, damaged, or incorrectly marked as delivered. We may request reasonable information and coordinate an investigation.

Our investigation process does not remove mandatory replacement, refund, or other rights.

8. Returns and Refunds

Fourteen-Day Cancellation Period

You may notify us that you wish to cancel a purchase within 14 calendar days after receiving the product, without giving a reason, subject to lawful exceptions.

Contact contact@ultracleany.com with your order details and an unequivocal statement that you wish to cancel.

Where statutory withdrawal rules apply, the period and its calculation follow those rules, including applicable rules for orders delivered in separate parts.

Any longer return period expressly advertised for your order also applies according to its disclosed conditions.

Return Conditions

For voluntary change-of-mind returns beyond mandatory statutory rights, products must be unused, in their original condition, with their labels, accessories, and original packaging.

Where a statutory withdrawal right applies, you may handle the product as permitted by law to establish its nature, characteristics, and functioning. We may deduct legally recoverable diminished value caused by handling beyond that permitted level.

Original packaging should be returned where available, but missing packaging does not automatically defeat a statutory right where the law provides otherwise.

Health and Hygiene Exceptions

A statutory withdrawal exception for sealed goods unsuitable for return for health protection or hygiene reasons applies only where the product and circumstances legally qualify and the seal has been broken after delivery.

The fact that a product is an ultrasonic cleaner or may be used with dental appliances does not, by itself, establish that the exception applies.

Hygiene-related restrictions do not remove rights concerning defective, unsafe, misdescribed, or nonconforming goods.

Return Shipping

You pay direct return shipping costs for a change-of-mind return where this was disclosed before purchase and applicable law permits that allocation.

Where the product is defective or incorrect, we bear the return costs required by law.

Contact us for the appropriate return address. A request for return instructions does not make statutory cancellation conditional on discretionary approval.

Where a statutory deadline applies, return the goods within that deadline. Under applicable EEA and UK withdrawal rules, this is generally within 14 days after communicating withdrawal.

Refunds

We refund amounts due through the original payment method unless you expressly agree otherwise without additional cost.

For statutory EEA and UK withdrawal, reimbursement is made within the legally required period, generally 14 days after we receive notice. We may withhold reimbursement until we receive the goods or evidence of return, whichever occurs first, where permitted.

Where no different mandatory deadline applies, we process an approved refund within 14 days after receiving and reasonably inspecting the return.

Standard outbound delivery charges are refunded where required by law. Additional costs for an upgraded delivery method need not be refunded beyond the standard delivery amount where the law permits.

For voluntary returns where no law requires reimbursement of original shipping, those charges are nonrefundable.

Your payment provider may require additional time to display a processed refund.

Model Withdrawal Form

You may use the following form, although doing so is not mandatory.

To Ultra Cleany, at the seller’s address identified in Section 2, contact@ultracleany.com.

I hereby give notice that I withdraw from my contract for the purchase of the following goods.

Date received

Customer name

Customer address

Date of notice

Customer signature, only if submitted on paper

9. Product Warranties and Statutory Guarantees

Statutory Protection

Products are covered by the statutory guarantees and conformity requirements applicable to the transaction.

For EEA consumers, the legal conformity period is generally at least two years, with longer periods in some countries. For example, qualifying new goods sold to consumers in Spain are subject to a three-year conformity period.

UK, Canadian, Australian, Japanese, US, and other rights depend on the applicable law. These rights are not automatically limited to two years.

Any separately advertised commercial warranty supplements mandatory rights and applies according to its disclosed terms. A commercial warranty does not replace or shorten statutory protection.

Defective Products

If a product is defective or does not conform to the contract, available remedies may include repair, replacement, a price reduction, rejection, or a refund, depending on the applicable law and circumstances.

Notify contact@ultracleany.com and provide reasonable proof of purchase and information about the issue.

Damage caused by misuse, incompatible items, unauthorized modifications, or failure to follow instructions is not automatically a manufacturing defect. The cause of the problem and applicable law determine entitlement to a remedy.

We do not require original packaging where mandatory law makes that an unlawful condition of a remedy.

Australian Consumers

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

UK Consumers

Where the Consumer Rights Act 2015 applies, remedies may include a short-term right to reject faulty goods, normally within 30 days, followed by applicable repair, replacement, price reduction, or final rejection rights.

10. Product Use, Valuable Items, Disclaimers, and Limitation of Liability

10.1. Intended Use and Compatibility

Ultra Cleany is intended for cleaning items suitable for ultrasonic cleaning, according to the instructions for the particular device and item.

References to eyeglasses, jewelry, dental appliances, or other categories do not mean that every item in those categories is compatible.

You are responsible for selecting items, checking their condition and suitability, and following the device manual and the item manufacturer’s care instructions.

Where suitability is uncertain, do not place the item in the device until its manufacturer or an appropriately qualified professional has confirmed compatibility.

10.2. Items of Significant Financial or Sentimental Value

We recommend that you do not place items of significant financial or sentimental value in the device.

This includes irreplaceable possessions, heirlooms, antiques, unique jewelry, collectible items, and objects for which damage or replacement would create a substantial personal or financial loss.

Seek appropriate professional advice or professional cleaning for such items.

10.3. Delicate Materials and Existing Deterioration

Inspect items before cleaning. Do not use the device for items with conditions that make ultrasonic cleaning unsuitable, including loose stones or components, cracks, peeling coatings, deteriorated finishes, weakened adhesives, or other damage.

Special coatings, surface treatments, gemstones, porous or organic materials, glued components, and delicate finishes may require item-specific restrictions.

Cleaning may reveal damage previously hidden by dirt. It may also worsen existing deterioration in an incompatible or already damaged item. The appearance of damage after cleaning does not, by itself, establish when it arose or its cause.

10.4. Operating Instructions

Follow the manual concerning filling, cleaning duration, liquids, electrical safety, and compatible items.

Do not use substances or operating methods prohibited by the manual. Do not immerse electrical components that are not designed for immersion, modify the device, or continue using a device showing signs of electrical or mechanical damage.

After cleaning, follow the item manufacturer’s rinsing and drying instructions.

10.5. Dental Appliances and Hygiene Claims

Follow the dental appliance manufacturer’s instructions and obtain advice from your dental professional where needed.

Cleaning is not automatically equivalent to sanitization, disinfection, or sterilization. The device does not replace a separate disinfection procedure required for a particular item unless that function is expressly specified and supported for the relevant model and use.

Website information is not individualized dental, medical, optical, or jewelry-care advice.

10.6. Customer Responsibility and Assumption of Risk

Subject to the mandatory exceptions in Section 10.11, you place items in the device at your own risk and accept the risks associated with the item’s materials, condition, incompatibility, and your use of the device.

This allocation does not make you responsible for our own legally non-excludable acts, omissions, product defects, or breach of mandatory guarantees.

10.7. Exclusion of Liability for Damage to Items

To the fullest extent permitted by applicable law, Ultra Cleany excludes liability for damage, scratching, discoloration, corrosion, loosening, coating deterioration, wear, loss of function, or other loss affecting items placed in the device.

This includes, to that same extent, damage attributable to incompatibility, preexisting defects, deterioration, unsuitable cleaning agents, unauthorized modifications, or failure to follow applicable instructions.

To the extent this exclusion is legally enforceable, you agree not to seek reimbursement, repair or replacement costs, compensation for sentimental value, or other damages for losses covered by the exclusion.

If, notwithstanding this exclusion, Ultra Cleany is found legally liable for damage to an item placed in the device, the alternative limit in Section 10.10 applies only where that liability may lawfully be limited.

10.8. Website and Warranty Disclaimers

To the fullest extent permitted by law, the website is provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, or the absence of all harmful components.

For products, any exclusion of implied warranties, including MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE, applies only where a valid exclusion is legally permitted.

No disclaimer contradicts an enforceable express warranty, excludes a mandatory statutory guarantee, or disclaims an implied warranty where a written warranty or applicable law prohibits doing so.

10.9. Exclusion of Certain Losses

To the fullest extent permitted by applicable law, Ultra Cleany and its officers, employees, agents, and relevant service providers are not liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from website use, products, or these Terms, including lost profits, business interruption, lost data, or loss of goodwill.

This exclusion applies only to losses that may lawfully be excluded. Describing damage as consequential does not remove a statutory entitlement to compensation.

10.10. Alternative Liability Limit for Damage to Items

If, notwithstanding the exclusion in Section 10.7, Ultra Cleany is found legally liable for damage to an item placed in the device, and that liability may lawfully be limited, our total aggregate liability for all affected items and related losses arising from the same incident will not exceed US $300.

This limit applies specifically to damage to items placed in the device and related losses arising from that incident. It is not calculated by reference to the purchase price of the device or the total amount of your order.

The US $300 amount is a maximum limit, not an automatic payment or an agreed valuation of any affected item. Compensation remains subject to establishing liability and the recoverable loss under applicable law.

This limit does not cap a refund due for the device itself or remove a mandatory repair, replacement, refund, or other statutory remedy concerning the device.

The mandatory exceptions in Section 10.11 apply to this limit.

10.11. Mandatory Exceptions

Nothing in these Terms excludes or restricts liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence where exclusion is prohibited, death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded or restricted.

Mandatory product liability, consumer guarantees, conformity rights, and compensation rights prevail over conflicting exclusions or limits.

Where our failure to meet a mandatory legal requirement causes damage for which the law makes us responsible, you retain the remedies available under that law.

10.12. Reporting an Alleged Damage Incident

Stop using the device and contact contact@ultracleany.com if you believe it has damaged an item.

Keep the device and item available for reasonable inspection, where practicable. We may request photographs, order details, the item’s make and model, information about its prior condition, cycle duration, liquids used, and any relevant professional assessment.

These requests assist investigation. They do not reverse statutory burdens of proof or impose unlawful conditions on a claim.

10.13. Third-Party Claims Arising from Misconduct

To the extent permitted by law, you are responsible for third-party losses caused by your fraudulent or unlawful use of the website, infringement of third-party rights, or deliberate material breach of these Terms.

Any obligation to reimburse us is limited to losses reasonably attributable to that conduct, including reasonable legal costs where recoverable. It does not require you to indemnify us for our own fault or for exercising a consumer right or bringing a good-faith complaint.

11. Data Protection and Electronic Communications

Protecting personal information is important to us. Please review our Privacy Policy and Cookie Policy for information about collection, use, disclosure, tracking technologies, and your choices.

Acceptance of these Terms does not replace separate consent required for marketing, nonessential tracking, or other processing.

We may send order confirmations, invoices, service notices, and other transaction-related communications electronically, subject to applicable legal requirements.

Keep your contact details accurate. An electronic communication has legal effect only to the extent recognized by applicable law.

12. Intellectual Property, Reviews, and Submissions

Website Content

All website content, designs, graphics, trademarks, logos, and trade names belong to Ultra Cleany or third parties that have licensed their use.

Copying, reproducing, distributing, modifying, or commercially exploiting this material without prior written consent is prohibited except as permitted by law.

You may view and retain reasonable copies for personal, noncommercial reference, including copies of transaction documents and these Terms. This does not transfer ownership or grant a commercial license.

Reviews and Public Submissions

You retain ownership of content you submit.

For reviews, photographs, or other content you intentionally submit for public display, you grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, and format that content for operating the website and presenting genuine customer feedback, subject to applicable privacy and publicity rights.

Advertising uses requiring separate permission remain subject to that permission. Private support correspondence is not automatically licensed for public advertising.

You confirm that you have the necessary rights to submitted content and that it does not knowingly mislead, unlawfully disclose another person’s information, or infringe third-party rights.

We may remove unlawful, fraudulent, irrelevant, or abusive submissions. We do not prohibit honest negative reviews or condition consumer remedies on removing a review.

Copyright Complaints

Send copyright complaints to contact@ultracleany.com with identification of the protected work, the allegedly infringing material and its location, your contact details, and an explanation of your authority to complain.

Where a formal statutory notice procedure applies, include its required declarations and signature. This contact provision does not represent that we have registered a designated DMCA agent unless that registration has actually been completed.

13. Changes, Termination, and General Provisions

Changes

We may modify these Terms as explained in Section 3. Review them periodically.

Changes apply prospectively, subject to required notice and acceptance. Material amendments to arbitration do not apply to existing disputes without a valid agreement.

Termination

We may terminate website access for the reasons described in these Terms, subject to applicable law.

Termination does not cancel outstanding payment, delivery, refund, warranty, privacy, or other obligations. Provisions intended to survive, including applicable intellectual property, liability, and dispute provisions, survive to the extent lawful.

Events Beyond Reasonable Control

We are not liable for failure caused by events beyond our reasonable control to the extent permitted by law. We take reasonable steps to reduce their effects.

This provision does not remove mandatory cancellation, refund, delivery, or compensation rights.

Assignment

We may transfer contractual rights and obligations as part of a lawful business transfer, provided this does not unlawfully reduce your rights or guarantees.

Neither party may use assignment to evade obligations. Restrictions on your assignment apply only where lawful.

No Waiver

A failure to enforce a provision on one occasion does not automatically waive the right to enforce it later.

Severability

If a provision is invalid or unenforceable, it is severed or limited only to the extent permitted by law. The remaining provisions continue where they can lawfully operate.

Section 14 contains additional rules for the arbitration agreement. This clause does not authorize rewriting an unfair term where applicable law prohibits doing so.

Entire Agreement

These Terms, accepted order information, and applicable incorporated policies form the agreement concerning the transaction.

This does not exclude enforceable precontractual statements, express warranties, fraudulent misrepresentation claims, or rights protected by law.

14. Governing Law, Jurisdiction, Arbitration, and Class Action Waiver

14.1. Governing Law

Subject to mandatory protections, these Terms are governed by Wyoming law, without applying conflict-of-law rules that would defeat those protections.

For the US arbitration agreement below, the Federal Arbitration Act governs its interpretation and enforcement to the extent applicable.

A choice of Wyoming law does not deprive consumers of mandatory protections afforded by the law applicable to them, including protections of their country or state of residence where those protections cannot be displaced by contract.

14.2. Scope of the US Arbitration Agreement

Sections 14.3 through 14.11 apply to customers residing in the United States who validly accept this arbitration agreement, except where arbitration or the relevant waiver is prohibited or otherwise unenforceable.

They do not automatically impose mandatory arbitration on consumers residing outside the United States.

UNLESS YOU VALIDLY OPT OUT OR AN EXCEPTION APPLIES, YOU AND ULTRA CLEANY AGREE TO RESOLVE COVERED DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION. THIS GENERALLY REPLACES A COURT OR JURY TRIAL FOR THOSE DISPUTES.

14.3. Informal Resolution

Before commencing arbitration, either party should send the other written notice explaining the dispute, relevant transaction information, and requested resolution.

Send notices to contact@ultracleany.com. We send notices to the contact information associated with your transaction or another address you provide.

The parties will make a good-faith effort to resolve the dispute for 30 days after receipt.

This process does not bar access to small claims court, urgent protective relief, regulators, or a filing necessary to preserve a legal deadline. Failure to complete this process does not automatically forfeit a claim.

To the extent permitted, applicable limitation periods are suspended during this agreed informal resolution period.

14.4. Covered Disputes

Covered disputes include claims between you and Ultra Cleany arising from or relating to an order, product, warranty, advertising, website service, or these Terms, whether based in contract, tort, statute, or another legal theory.

This applies only to disputes falling within a validly accepted agreement and excludes claims that applicable law makes nonarbitrable.

14.5. Administrator and Rules

Arbitration will be administered by the American Arbitration Association, known as AAA, before one neutral arbitrator under its applicable Consumer Arbitration Rules.

Rules, filing information, and fee information are available at www.adr.org.

Applicable AAA rules, including any procedures required for multiple filings, apply. This agreement does not create a separate batching or delay requirement.

If AAA cannot administer a dispute for reasons unrelated to our refusal to comply or pay, the parties may agree on another qualified administrator. If no lawful alternative can be agreed or appointed, the dispute may proceed in a competent court.

We will comply with applicable administrator review, registration, payment, and participation requirements. We will not rely on our own failure to comply to prevent you from pursuing a remedy.

14.6. Location, Participation, and Fees

Arbitration may proceed through documents, telephone, or video where permitted by the rules and appropriate to the dispute.

If an in-person hearing is required, its location will follow applicable consumer rules and law and will not require unreasonable travel as a condition of pursuing a claim.

You pay no more than the consumer fees permitted by applicable AAA rules and law. We pay the fees and arbitrator compensation allocated to the business.

Available fee waivers apply. Each party ordinarily bears its own legal fees unless applicable law or a lawful award provides otherwise.

14.7. Authority and Remedies

A court determines whether the parties formed an arbitration agreement and whether the class action waiver is enforceable. Other issues are allocated under applicable law and AAA rules.

The arbitrator applies applicable substantive law and may award the relief available on an individual claim, including statutory damages, legal fees, and equitable relief where authorized.

The arbitrator issues a reasoned written award. Judgment may be entered in a competent court. Judicial review is limited as provided by law.

Nothing requires secrecy that prevents consulting advisers, presenting evidence, reporting to authorities, discussing the underlying facts where protected, or enforcing legal rights.

14.8. Exceptions

Either party may bring an eligible individual claim in small claims court, provided it remains within that court’s jurisdiction.

Either party may seek temporary court relief necessary to preserve rights or the effectiveness of arbitration without waiving arbitration of the merits.

Nothing restricts complaints to regulators, cooperation with investigations, or remedies that applicable law makes nonwaivable.

Requests for public injunctive relief are not waived. If applicable law requires a particular claim or remedy to proceed in court, that claim or remedy may proceed there while arbitrable claims remain subject to arbitration, subject to lawful case-management orders.

14.9. Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND ULTRA CLEANY AGREE THAT COVERED DISPUTES WILL BE PURSUED INDIVIDUALLY, NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

The arbitrator may not conduct a class arbitration without the parties’ express written agreement.

This does not prohibit coordinated legal representation, protected communications, applicable administrative procedures, or relief that cannot lawfully be waived.

If the waiver is unenforceable for a particular claim or remedy, that claim or remedy proceeds in a competent court to the extent required. The remainder of the arbitration agreement continues where lawful.

14.10. Thirty-Day Opt-Out

You may opt out of the arbitration agreement and class action waiver by emailing contact@ultracleany.com within 30 days after first accepting this version of the arbitration agreement.

Include your name, the email associated with your purchase or account, an order reference if available, and a clear statement that you opt out of arbitration and the class action waiver.

No special wording or explanation is required. Keep a copy of the sent notice.

Opting out does not affect your purchase, warranty, return rights, or access to services. If you validly opt out, neither party may require arbitration under this agreement.

14.11. Survival and Changes

A validly accepted arbitration agreement survives completion or termination of the transaction to the extent permitted by law.

Changes do not retrospectively impose arbitration on an existing dispute. Any material change is subject to legally required notice and assent.

14.12. Consumers Outside the United States

For consumers outside the United States, disputes may be brought before courts available under applicable mandatory jurisdiction rules.

Consumers in the EEA and UK retain rights to rely on mandatory consumer protections and access the courts available to them under applicable law.

For Quebec consumers, these Terms do not impose pre-dispute mandatory arbitration, prohibit a class action, or deprive them of the right to participate in one.

Canadian consumers elsewhere, and consumers in Australia, Japan, and other jurisdictions, retain nonwaivable access to courts, collective proceedings, statutory remedies, and complaint mechanisms.

The parties may agree to voluntary mediation or arbitration after a dispute arises where lawful.

14.13. Court Proceedings

For proceedings not subject to arbitration, courts in Wyoming may be used where they have jurisdiction and the choice is lawful.

This is not an exclusive venue requirement that displaces a consumer’s mandatory right to bring or defend proceedings elsewhere.
